Article 3 — Products and customisation

Croco Print offers print-on-demand products, customised according to the elements (artwork, text, files) supplied by the customer via the site or its online designer. The customer is solely responsible for the content they send.

For customised orders, a proof — a preview of the result before printing — may be offered to the customer. Unless otherwise stated, confirming the order constitutes acceptance of the artwork positioned as shown in the designer or as sent by the customer.

The photographs and visual representations of products on the site are provided for illustration and are not contractually binding.

Article 4 — Intellectual property and content supplied by the customer

By sending artwork, a logo, an image or any other content intended for printing, the customer guarantees that they hold all the necessary rights (copyright, image rights, trademark rights) to this content, or that they have the permissions required for its use and reproduction.

Croco Print reserves the right to refuse to print any content that is manifestly unlawful, infringing, offensive or contrary to public order, without this refusal giving rise to any compensation. The customer remains solely responsible for the content they supply and indemnifies Croco Print against any third-party claims in this respect.

Article 5 — Prices

Prices are shown in euros (€), inclusive of all taxes. Quantity tier discounts may apply automatically according to the conditions shown on the product page. Delivery costs are shown before the order is finally confirmed. Croco Print reserves the right to change its prices at any time, products being invoiced on the basis of the prices in force at the time the order is confirmed.

Article 6 — Orders

The customer selects the products, customises them where applicable via the designer, adds them to their basket and then confirms their order after checking the summary. The order is only final once payment has been confirmed. A confirmation e-mail is sent to the customer.

Article 7 — Payment

Payment is made online, at the time of ordering, via the payment methods offered on the site (bank card, PayPal). Payment is secured by Stripe and PayPal. The order is only processed once payment has been received.

Article 8 — Delivery

Delivery times are given as a guide on the Delivery & lead times page and at checkout; they run from the approval of the proof when one is required. Croco Print cannot be held responsible for delays caused by the carrier or by force majeure. In the event of a damaged parcel or non-conformity on receipt, the customer is invited to contact customer service as soon as possible.

Article 9 — Right of withdrawal

In accordance with article L221-18 of the French Consumer Code, the customer in principle has 14 days to exercise their right of withdrawal on an online purchase.

However, in accordance with article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Products printed from artwork, text or a file supplied or customised by the customer (custom textiles, posters, stickers, made-to-measure DTF sheets) fall under this exception and therefore cannot be subject to a right of withdrawal, except in the case of a lack of conformity or a hidden defect.

Article 10 — Warranties

The products sold are covered by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of a proven lack of conformity not attributable to the content supplied by the customer, Croco Print will, as appropriate, replace or refund the product concerned.

Article 11 — Complaints and mediation

For any complaint, the customer can contact customer service at contact@crocoprint.fr. If a dispute is not resolved amicably within 60 days, the consumer may use, free of charge, the consumer mediation service to which CROCO PRINT belongs:

CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris
www.cm2c.net

The European online dispute resolution platform is also available at: ec.europa.eu/consumers/odr.

Article 12 — Personal data

Personal data collected when ordering is processed in accordance with our privacy policy, in compliance with the General Data Protection Regulation (GDPR).

Article 13 — Applicable law and disputes

These terms and conditions are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the courts of Nîmes shall have sole jurisdiction, unless a mandatory legal provision applicable to consumers provides otherwise (in particular the consumer's right to bring the matter before the court of their own place of residence).
